Mesquida Mora is the commercial name used by Mesquida Mora for the project of online sales of articles.
The present Conditions regulate the Access to and use of the website https://mesquidamora.com (the “website”) owned by MESQUIDA MORA SL (“Mesquida Mora”), with VAT code B57761132 and registered address at Camí Pas des Frare s/n, Bústia Rural, 5 / Pol. 14 – PAC. 782, 07260 Porreres, Balearic Islands, and the services and products offered by Mesquida Mora on its website.
Mesquida Mora offers this website subject to the present Conditions. By visiting the website or using the services or applications of the website, the user accepts these Terms and Conditions.
Accessing the website does not require registration as a user, but contracting any of the services offered by Mesquida Mora does require registration as a user and acceptance of these Conditions before making payment.
The Conditions of Mesquida Mora described below define the rights and obligations of Mesquida Mora and the users within the framework of the website. These are the only Terms and Conditions applicable to the use of the website (although particular conditions may exist for certain services), including the contracting of orders via e-commerce and substitute any other conditions, barring prior written agreement between Mesquida Mora and the user.

In order to acquire the products offered via the website, the user will have to register by means of the registration form available on the website.
The user will be responsible for maintaining the confidentiality of the data and information provided and to restrict Access to their computer and access codes to prevent unauthorised use.
If the user has any reason for believing that their data have been disclosed to a third party or have been used in an unauthorised manner or are likely to be so used, they must report this situation to Mesquida Mora immediately.

4. Orders and purchasing conditions
The services and products offered via the Mesquida Mora website are addressed to the purchase by users of food products related with apiculture (honey, pollen, propolis, etc.)
In order to contract an order with Mesquida Mora, the user must be at least 18 years of age.
Before placing an order via the website, the user must complete the purchasing form by providing a series of data which will be necessary for processing the order.
Once the data have been completed on the form, the user must proceed to the payment of the order via the means of payment specified in the website.
Once payment has been made, the user will receive an e-mail message confirming the order and including a summarised list of the articles acquired, the requested shipping modality and the destination address.
If at the moment of making payment there occurs an incident which prevents making it, the user will receive an automatic payment error message, and their order will not be processed until the payment process has been successfully completed.
The prices of the products and services are expressed in euros (€). The prices include the taxes and processing fees. The shipping costs will be indicated at the moment of definitive confirmation of each order.
All the prices shown are final, excluding the shipping costs, and expressly including Value Added Tax (VAT). The user may obtain detailed information on the price of the product at any moment.
Mesquida Mora may periodically offer discount codes to its users. These discounts may only be applied in accordance with the instructions specified by Mesquida Mora in regard to each code, and in all cases the users may use only one single code for each order.
The use of discount codes will not be compatible with certain promotional actions and packs.
Mesquida Mora will ship orders to all the territories of the European Community.
Unless there specific requests for out-of-stock products, or in the event of unforeseen or extraordinary circumstances, the order consisting in the related product/s in each Shipping Confirmation will be shipped within a maximum of 7 business days of the date of the Order Confirmation.
If for some reason we are unable to comply with the delivery date, we will inform the user of this circumstance and give them the option of continuing with the purchase, setting a new delivery date, or cancelling the order, with the total refund of the price paid.
To the effects of the present Conditions, it will be understood that the “delivery” has been made or that the order has been “delivered” at the moment when the user or a third party indicated by the user takes material possession of the products, which will be certified by means of the signing of the receipt of the order at the agreed delivery address.
Legal right to withdraw from the purchase
The user is not entitled to withdraw from the present agreement as it concerns a food product, as is ruled in Royal Legislative Decree nº 1/2007 of 16 November passing the redrafted text of the General Act for the Defence of Consumers and Users.
Returns of defective products
In any cases in which the user considers that at the moment of delivery the product does not adhere to what was stipulated in the agreement, they must contact us immediately at firstname.lastname@example.org or via our contact form, providing the details of the product and the damage it has suffered. The product may be returned to the address stated above. We will examine the returned product in detail and inform the user via e-mail within a reasonable time whether a refund or replacement is in order. The refund of the price paid or the replacement of the article will be carried out as soon as possible, and in any case within the 14 days following the date of our e-mail confirming the correctness of the refund of the price paid or the replacement of the non-compliant article. The amounts paid for any products returned due to some tare or defect, when this truly exists, will be refunded in full, including the shipping expenses incurred to deliver the article and any costs the user may have incurred to return it to us. The refund will be carried out by the same means of payment used to pay for the purchase.
7. Product change policy
Mesquida Mora does not admit any change between a product purchased by the user and another product offered on the website.
8. Information on Mesquida Mora products and services
The data included in the website in each description of the products and services, their photographs, graphic or iconographic representations, videos, commercial names, trademarks or distinctive signs of any type, have a merely informative function. Consequently, Mesquida Mora declines any liability for the appearance of errors or omissions in this information, although it undertakes to tale all the measures in its power to correct them at the earliest possible moment once it has been informed of them.

It is not permitted to use the website for purposes which are fraudulent or related with criminal offences or unlawful activities of any nature.

The rest of the elements and browsing structures and the various elements of the website are the property of Mesquida Mora, which holds the exclusive exercise of the exploitation rights in any form and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with the applicable Spanish and European legislation.
Mesquida Mora declares that it does not grant any express or implicit licence or authorisation whatsoever on the intellectual and/or industrial property rights or on any other right or property directly or indirectly related with the contents included in the website. Total or partial reproduction of the contents of the website is totally prohibited, even by means of a hyperlink, without the prior express written consent of Mesquida Mora. Unauthorised use of these contents will give rise to the legally established liabilities.
12. Exclusion of guarantees and liability

14. Partial nullity
In the event of any clause of the present Conditions being declared null and void, the remaining clauses will continue to be valid and will be interpreted taking into account the spirit of the present Conditions.
Mesquida Mora reserves the right to make, without prior notice, any modifications it may consider pertinent in its portal, being able to change, eliminate or add both the contents and services provided through it and the form in which they appear presented or located in its portal.
All the communications between Mesquida Mora and the user relating to the contracting of orders through the website will be made in writing and in accordance with the communication procedures established in these Terms and Conditions for each case in particular.
18. Applicable legislation and jurisdiction
The present Conditions are subject to Spanish legislation. Pursuant to Royal Legislative Decree nº 1/2007 of 16 November passing the redrafted text of the General Act for the Defence of Consumers and Users and other complementary legislation, the contracting parties submit to the courts and tribunals of the place of residence of the user.
In addition, under the terms of Regulation (EU) nº 524/2013 of the European Parliament and the Council of 21 May 2013 on online dispute resolution for consumer disputes, Mesquida Mora informs you that, in the event of dispute, a user resident in the European Union may access the Online Dispute Resolution Platform developed by the European Commission with the aim of attempting to resolve extrajudicially any dispute which may arise out of the provision of services by Mesquida Mora.
